ACCIDENT LAWYER

SEARCH FOR EVIDENCE

1. Capture the situation of the traffic accident on a photo, video, sheet of paper

   • Vehicle damage

   • Mutual location of the vehicle

   • Braking distance

   • It is important to establish the place of the talus (dirt, headlight glass, etc.)

   • Write down the name and contact details of the witnesses

   • Check the correctness of measurements at the scene

2. Find the video

   • Look around where street cameras can be installed. If you find it, ask the owners to provide you with a copy of the video.

PROTOCOLS FOR ALL PARTICIPANTS

1. Require a report on an administrative offense against all participants in the accident

   • Agree that it will be right if the culprit is determined by the court and not the police officer on the spot

   • Unfortunately, the law is currently such that the police officer decides at his own discretion at the scene of the question on whom to draw up a report and on whom not. If the report on an administrative offense on other parties of road accident isn't made, accordingly and their fault it won't be considered by court.  This will complicate the compensation procedure if it turns out that you are not to blame

   • even if in your opinion it is obvious that you have violated traffic rules…

DRUNK TEST FOR ALL PARTICIPANTS

1. Require a test (collection of biological samples) on all participants in the accident

   • This is important because a driver without signs of alcohol intoxication may be under the influence of drugs or psychotropic substances.

POLICE FOR STAKHOVA MANDATORY

1. Call the police even if you have a full CASCO. The European protocol does not pass

   • Insurance companies refuse to pay under the contract if the police do not draw up a certificate or report on the accident (usually the text is included in the insurance contract)

THERE CAN BE A CLAIM AFTER THE COURT'S DECISION

1. Before the court hearing on the minutes of your administrative offense, consult a lawyer.

   • Undisputed admission of guilt by you in the administrative case will not only entail the imposition of a fine of 300-500 hryvnia, but may be in the future  used when filing a lawsuit against you for damages caused by an administrative offense in a significant amount (100-500 thousand UAH)

   • Even if your liability is insured, your insurance company can "bargain" with the victim and persuade him to write a statement of "agreement on the amount of insurance indemnity" where he agrees to indemnify only part of the damage caused by the examination. For the rest of the amount, the victim can file a claim for recovery of damages from you.

   • When considering a civil case, the decision to find you guilty of an accident will be mandatory. Only the question of what amount of damages to recover from you will be resolved.

GUILT IS NOT OBVIOUS

1. Even if you think you are to blame for an accident, this is not always the case.

   • Your actions or omissions must be in direct causal connection with the occurrence of the accident. That is, you could violate the Traffic Rules, but the accident could not have occurred if, say, the other party complied with the speed limit, reacted in a timely and correct manner (immediate braking to a complete stop, safe detour, etc.)

Do not refuse the services of a lawyer, no matter how you are persuaded by a police officer at the scene or a judge during the trial. This may not work in your favor!
